These Terms & Conditions (Terms) govern your access to and use of www.aliga.com.au and related pages, content, forms, and tools (Website). By using the Website you accept these Terms. If you do not agree, please do not use the Website.
“ALIGA”, “we”, “us” and “our” means ALIGA Pty Ltd (ABN 15 614 305 458) and, where relevant, related entities within the ALIGA Group (e.g., ALIGA Medical, ALIGA Properties). Website features and styling are aligned with our current brand guidelines and service catalogue (engineering, client-side project management, inspections/certification, traffic & transport, town planning, drone services, AI solutions, and workforce).
You must not misuse the Website, interfere with security, introduce malware, attempt to access non-public areas or data, scrape content, or use automated means without written consent. You must comply with applicable laws and respect our intellectual property and privacy obligations.
Content on the Website is general information only. It is not engineering, legal, planning, safety, or commercial advice. Do not rely on any page as a substitute for project-specific professional services or RPEQ sign-off (Form 15/16). Engineering services in Queensland will only be performed under a written engagement by, or under the direct supervision of, a Registered Professional Engineer of Queensland (RPEQ) as required by the Professional Engineers Act 2002 (Qld).
Note: Our team includes RPEQ-certified engineers and the business operates ISO 9001 / ISO 45001 / ISO 14001 management systems; however certification references on the Website are informational and do not themselves constitute certification for your project.
We aim to keep information accurate and up to date but make no representation that content is complete, current, or error-free. Features and content may be updated or withdrawn without notice, and the Website may be unavailable from time to time.
Unless stated otherwise, Website content is © ALIGA under the Copyright Act 1968 (Cth). You may view the Website and print/download a single copy for personal, non-commercial use with notices intact. Any other use (including reproduction, distribution, adaptation, scraping, training of models, or republication) requires prior written consent.
Trade marks, logos and brand elements (including the ALIGA name and marks) are protected. Do not use them without permission or in a way that implies endorsement.
Links or embeds (e.g., booking tools, chat, social media, maps, media players) are provided for convenience. We do not control or endorse those sites/services and are not responsible for their content, security, or availability. Your use of third-party services is at your own risk and subject to their terms and privacy policies.
Personal information submitted via Website forms (e.g., Contact, Careers/EOI, RFQ/Panel) is handled under our Privacy Policy in accordance with the Australian Privacy Principles under the Privacy Act 1988 (Cth). We operate a breach response process and, where required, will notify affected individuals and regulators under the Notifiable Data Breaches scheme.
We use analytics and may use cookies or similar technologies to improve experience and performance. You can adjust your browser settings to manage cookies; some features may not function without them. By submitting a form, you confirm the information is accurate and that you are authorised to provide any third-party details (e.g., referees).
Website forms and booking widgets are enquiry tools only and do not create an agreement, engagement, or offer. All services are subject to our proposal or contract terms (including panel call-offs, purchase orders, or written instructions issued by a client/authority). Submission timeframes and instructions published on government portals prevail over Website copy.
If you opt-in to receive updates, proposals, event invites, or job alerts, we (or our service providers) may send electronic messages. We only send commercial electronic messages with consent and include an easy unsubscribe in each message. Unsubscribes are actioned promptly. We do not use harvested address lists. This applies to communications sent to candidates as well as clients and prospects under the Spam Act 2003 (Cth).
To the maximum extent permitted by law, we exclude all warranties, conditions and guarantees not expressly set out in these Terms or required by law, and we are not liable for indirect or consequential loss, loss of profit, data, or business interruption arising from your use of (or inability to use) the Website.
Australian Consumer Law (ACL): Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right or remedy you may have under the Competition and Consumer Act 2010 (Cth) or similar legislation that cannot lawfully be excluded. Where our liability under the ACL cannot be excluded, it is limited (at our option) to resupply of the services or the cost of resupply, to the extent permitted by law.
Business use cap: For users who are not consumers under the ACL and who use the Website for business purposes, our aggregate liability for claims arising out of or in connection with the Website is limited to AUD 5,000, except in relation to liability that cannot be limited at law (including ACL guarantees). If any limitation is found to be unfair or void under the unfair contract terms regime, that limitation will not apply and the remainder of these Terms continue.
You agree to indemnify, defend and hold harmless ALIGA, its directors, employees and agents from and against any claims, liabilities, damages, losses or expenses (including reasonable legal fees) arising out of or in connection with your unlawful use of the Website, breach of these Terms, or infringement of intellectual property or privacy rights.
We are not responsible for any failure or delay in performance caused by events beyond our reasonable control, including natural disasters, acts of government, industrial actions, disruptions of communications or networks, third-party platform outages, or other force majeure events.
We may update these Terms from time to time. The effective date appears below. Your continued use of the Website after changes take effect constitutes acceptance of the updated Terms.
These Terms are governed by the laws of Queensland, Australia. The courts of Queensland (and any courts entitled to hear appeals from them) have exclusive jurisdiction.
